KDHX Validated and Future Ensured in Federal Court Ruling

On Monday, June 9, Judge Kathy Surrat-States approved the sale of KDHX’s FCC license.

The decision validates the integrity of our actions and affirms what we as an organization have known all along: that our efforts have been in good faith, in full compliance with our bylaws, and in service to our mission. 

As the court recognized, this transition allows KDHX to continue serving St. Louis and the region, while opening the door to new possibilities. This is not the end—it is the beginning. We look forward to reimagining and revitalizing how we bring our community together through innovative, community-driven media.

“The sale is in [KDHX’s] best interest, the sale is in good faith, it maximizes value,” Surratt-States said, “and it allows [KDHX] to continue to broadcast and continue to serve the community of St. Louis and the region.”

Surratt-States said KDHX leaders followed the law throughout the process, acted in good faith and only used powers that were granted to them by station bylaws. She also said KDHX’s impending reinvention as a digital-only station is a fulfillment of its mission.

Lawyers opposing the sale did not introduce any direct evidence pertaining to efforts by the Coalition for KDHX to raise funds and develop a reorganization plan, saving references to that effort for a closing argument.

Following a lengthy hearing, Judge Kathy A Surratt-States denied each objection to the sale made by a coalition of the station's supporters, plaintiffs in an unrelated case against the station, a creditor, and a group of former DJs and other volunteers called the League of Volunteer Enthusiasts of KDHX.

On each point, Surratt-States agreed with the station's lawyers that the objections had no merit or were mitigated by the circumstances.
